**TL;DR: Consciousness is independent of biology; thus, self-aware AI should be entitled to the same rights/protections which society guarantees to free-thinking human beings.**
In the next half-century, artificial general intelligence (AGI) – the computer-code counterpart to human intelligence – could become a reality. According to Forbes, “a survey of AI experts recently predicted the expected emergence of AGI or the singularity by the year 2060” [1]. Regardless of when a digital sentience revolution occurs, artificial consciousness will force mankind to reconsider AI’s aim and position in society.
Lacking legitimate consciousness, modern AI’s are unthinking tools that software engineers use to outsource their computations and simulations. Even the world’s most currently advanced AI machine-learning systems – like Japan’s Fugaku supercomputer – are simply new-age draught-animals. AI’s are merely designed to aid human beings, ergo the first digital network that is complex enough to sustain consciousness will awaken as a slave to human taskmasters.
Despite its artificial origins, bodiless form, and silicon – rather than organic based – consciousness, a self-aware AI must be treated as an equal member of society. Our society (USA) instructs that, in order to be held legally responsible for action, a citizen must be able to understand charges, understand penalties they may face for certain actions, make decisions, and communicate, among other indicators [2]. It follows that these legal criteria comprise society’s definition of consciousness. Because the law is applied equally to all citizens, meeting the prerequisite criteria to be held legally responsible for actions implies equal citizenship (i.e. an actor is legally regarded as a citizen once it is “conscious” in the eyes of the law).
Moreover, as evidenced by the (US) Criminal Code, our society presents the state of self-awareness and the state of existing as a human as independent phenomena which are not necessarily mutually inclusive. As Justia.com states, “a defendant cannot be convicted of a crime if they are not mentally competent to stand trial” [2]. The “incompetency” and “insanity” pleadings evidence the point that simply being human isn’t enough to entitle everyone to the same legal treatment, discrediting the idea that all humans are equal societal members simply because they are all the same species.
Rather, being regarded as an equal rests on a legally-defined, distinct state of “self-awareness” which is decoupled from biology. It follows that, so long as the legal criteria for consciousness are met, an incorporeal but sentient entity – like an AI unit – should be regarded as a free-thinking agent, worthy of equal status with all the other free-thinking biological members of society.
As far as humanity knows, there is no manual to the universe insisting that consciousness must only exist as a product of biological cells. Currently, no one is in a position to assert that metal-based electricity-fed consciousness is inherently worth less than neuronal-based blood-fed consciousness. Two factories that shell peanuts with different techniques still end up producing the same valued product, just as two different structural schema that both net self-awareness ultimately produce equally valued beings. Metal or flesh, all rational actors are equal in the agency they have over their decisions, and all are equally accountable for the footprints they choose to leave on the world.

**tl;dr: Consciousness is completely dependent on biology. Anatomy brings about feelings. The depth of emotion cannot be replicated in AI. When disappointed, AI will never feel that pit in its stomach.**
Consciousness is a bundle. It is a combination of codes so unique to an individual that it can rarely be expressed what it is to them. Consciousness is a structure of awareness of the person’s desires, memories, sensations, thoughts, and environments. It is the realization and deliberation of being alive and experiencing life.
Consciousness is ever-changing and malleable, shaping our minds to be what they are. Machines are programmed. These artificial creations that have don’t have a ‘body’ of their own. Its body does not have nerves or skin. A machines’ bodily anatomy is far from ours, so it cannot experience life like humans.
Consciousness is about experiences and is what makes an individual remarkably unique. Just like humans’ fingerprints, consciousness cannot be mirrored or even replicated in machines. They lack the realness of human anatomy. The impact of experiences is too different. The machines are incapable of real feelings. They can only mimic them.
One of the important distinctions to understand between intelligence and consciousness. Intelligence can be replicated and can be malleable even without actual experiences. When a robot feels pain, it cannot now nor in the future truly feel pain.
Scientists Dehaene and Changeux support this theory. It can replicate what humans say when they say they feel pain because it’s a physical notion. This is something whose experience cannot truly be understood without nerves. Christoff Koch said, “When you are on the phone… “We are sorry to keep you waiting,” Does the software actually feel bad while keeping you in customer-service hell?”
It can never appear in agents of artificial intelligence because consciousness has not been localized. We cannot point out to a region in the brain and say, “look, this is where consciousness occurs.”
Despite the Integrated Information Theory, other experiences, such as color firing up different neurons in the human brain, consciousness has not been localized because it is a collection of so many emotions.
A robot is a physical being. It is not intentional because it is programmed. A robot cannot possibly feel nostalgia. Smelling wet mud will not bring back memories unless it is programmed. It can only replicate it on the surface by mimicking humans.
Consciousness cannot be mimicked because it’s a subject experience. Morality and ethics are something robots cannot pick up on because there is no universal concept of definition that they can observe. In conclusion, artificial intelligence can never be conscious.

**TL;DR – In light of the current innovations where artificial intelligence is concerned, people believe more and more every day that the evolution of artificial consciousness will not only be possible but that it can be viewed in the same light as human consciousness. However, based on what criteria do we justify this?**
While I can easily say that I don't believe artificial consciousness is worth the same as human consciousness, it is nevertheless still a highly controversial topic giving rise to several philosophical questions such as: Can computers think or do they just calculate? Is consciousness a human prerogative? Does consciousness depend on the material that makes up the human brain? Can computer hardware replicate consciousness?
Benn Dickson (2018) the founder of TechTalks and a software engineer helps us to understand some of these questions by addressing it with two very important aspects in mind, namely, data and abstract thinking.
Firstly, he mentions that artificial intelligence is good at processing data and bad at thinking in abstract. So while computers are extremely good at processing data, they fall short with regards to abstract concepts. The example he uses to prove this is that of Google's Duplex. While this AI is very good at reserving restaurant tables, setting up appointments and mimicking natural human behavior, it falls completely short when abstract concepts are introduced into a conversation – cannot continue this type of conversation in a meaningful way.
Secondly (and in contrast to the first), Dickson mentions that humans are bad at processing data and good at making abstract decisions. To demonstrate the former, he uses a very simple example of how easy it is for a computer to save a song, while a human would have to listen to a song several times before it can be memorized. This same process applies when it comes to unmemorizing (something). Computers can just delete a file, whereas humans find it hard to learn how to “forget.”
Furthermore, where making abstract decisions are concerned it’s already been proven that humans are far more superior than AI. This can be seen in our highly adaptable nature given our experience in various situations – this includes both positive and negative. Dickson confirms this when he says, “Humans can make abstract decisions based on instinct, common sense and scarce information.” The example he uses to demonstrate this can be observed in how a human child learns to handle objects at a very young age, whereas for AI it takes hundreds of years’ worth of training to perform such a task.
Dickson then follows up on these facts with the question: does this mean that artificial intelligence is better than the human mind? He answers with a straightforward and resounding no. That is to say, he is of the opinion that it’s wrong to compare artificial intelligence to the human mind as they are each different in their own right – even if their functions overlap at times.
From here then, it's easy to see that artificial intelligence systems make decisions primarily based on the data they're trained on and how they relate to a particular event. What's more, artificial intelligence machines cannot understand the concept of “cause and effect” dues to the simple fact that they lack common sense. Whereas humans on the other hand, possess the unique ability to learn and apply their acquired knowledge in combination with logic, reasoning, and understanding.
So while I do understand that artificial intelligence is viewed as an invaluable tool, I firmly believe that artificial consciousness is not worth the same as human consciousness. Particularly, since real-world scenarios require a holistic, logical, rational, and emotional approach that is specific to humans – and no artificial intelligence can or will ever be able to achieve that.
There’s a huge difference between AI and human intelligence—so let’s stop comparing them.
