The Section 230 legal shield for social media represents one of the most consequential laws on Internet regulation. It has allowed the flourishing of the Internet and minimized the negative impacts. For this reason, it should remain an established law. Section 230 protects social media platforms from liability of content by their users. Therefore, the technology platforms do not have to share responsibility with their users. Subsequently, the law allows these companies to monitor their contents without violating the First Amendment. [1] Recently, Section 230 has received bipartisan criticism, though for different reasons. Without Section 230, the Internet may become very restricted. The absence of Section 230 opens platforms to myriad lawsuits for every questionable user comment. To filter these speeches, platforms will have to devote significant resources to content monitoring. The users will find themselves permitted to post limited content and experience significant censorship. Such an outcome will prove detrimental to technology companies, Internet users, and the society at large. Alternatively, repealing Section 230 can lead to an underregulated Internet. With Section 230, social media platforms become legally equivalent to publishers. Publishers can become liable for their contents since they typically moderate their publishing content in advance. To escape the legal threat, social media platforms can go the opposite of censorship. If they choose not to monitor any content, they have a better legal case of claiming no liability. In such a case, content rightfully regulated, such as child pornography and violent threat, can become widespread. While some on the political left credited Section 230 to the proliferation of hate speech, the alternative may become much worse. [3] Section 230 is in no way perfect.
